TERMS AND CONDITIONS

Medical Tourism Packages is a non-clinical facilitator. We do not provide medical advice, clinical interpretation, diagnosis, or treatment recommendations. All medical services are provided by independent licensed healthcare providers.

1. Document Hierarchy

These Terms and Conditions are supplemental to any Service Agreements (including, but not limited to, Quotes, Waivers, and KYC Disclosures) you execute with MTP. In case of conflict between this website content and any executed Service Agreement, the executed Service Agreement prevails.

2. Nature of Services

MTP Consulting S.A. (“Medical Tourism Packages,” “MTP,” “the Provider,” “we,” “us,” or “our”), registered in Panama under number 155756653, is a medical tourism FACILITATOR that coordinates logistics and introduces clients to licensed medical professionals and healthcare institutions in Latin America (Panama, Colombia, Costa Rica, Mexico).

What MTP Is NOT

MTP IS NOT a hospital, clinic, doctor, or healthcare provider. MTP does not:

  • Provide medical advice, diagnosis, or treatment
  • Practice medicine or any healthcare profession
  • Employ the physicians or medical staff who treat you
  • Own or operate the hospitals or clinics where you receive care

Administrative Verification Only

MTP may perform standard administrative verification of Healthcare Partners, which is strictly limited to confirming:

  • The validity and active status of medical licenses with relevant local authorities
  • Registration in stated specialties at the time of onboarding

This verification does NOT constitute:

  • A clinical audit or peer review
  • Medical clearance or competence assessment
  • Inspection of medical facilities
  • Evaluation of surgical techniques
  • Review of private malpractice history

Condition of Service

Engagement of MTP’s coordination services is strictly conditional upon the execution of specific Service Agreements and Liability Waivers. No medical coordination services will be initiated until applicable Service Agreements have been fully executed. The terms of those specific agreements will supersede these general website Terms.

3. No Medical Outcome Liability

MTP MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE CREDENTIALS, COMPETENCE, TRAINING, SAFETY RECORD, OR QUALITY OF ANY MEDICAL PROVIDER OR HEALTHCARE FACILITY.

All medical decisions (including diagnosis, evaluation, treatment selection, and post-treatment care) are made exclusively between you and your chosen medical provider. MTP has no role in and does not influence any clinical decision.

MTP bears NO responsibility for:

  • Medical advice or diagnosis
  • Treatment suitability, appropriateness, or outcomes
  • Surgical complications or adverse events
  • Dissatisfaction with results
  • Revisions, corrective procedures, or additional treatment
  • Post-operative care or recovery
  • Medical malpractice or negligence by providers
  • Injury, illness, or death arising from medical treatment

The process of informed consent is the sole responsibility of the medical provider. MTP does not explain medical risks, alternatives, or outcomes.

4. Assumption of Risk

You expressly assume all risks associated with medical tourism, including but not limited to:

  • Medical complications, unexpected outcomes, and adverse events
  • International travel risks (delays, cancellations, lost luggage)
  • Regulatory and legal differences between countries
  • Language and communication barriers
  • Visa or documentation delays and denials
  • Currency fluctuations and payment complications
  • Limited legal recourse in foreign jurisdictions
  • Differences in medical standards and practices
  • Post-operative complications occurring after return home
  • Need for follow-up care or revisions

Insurance Requirement

MTP does not offer, arrange, or guarantee any form of insurance, including:

  • Medical or surgical complication insurance
  • Travel insurance or trip cancellation coverage
  • Medical evacuation or repatriation insurance
  • Professional liability or malpractice insurance for providers

You are strongly advised to obtain comprehensive travel and medical insurance before undertaking medical tourism. Lack of appropriate insurance is a risk you assume independently.

5. Payment Structure

Fee Separation

Any fees payable in connection with MTP’s services consist of:

(a) Coordination Fee: A fee payable to MTP for coordination, logistics, and facilitation services (if applicable)

(b) Provider Fees: Medical, surgical, hospital, accommodation, travel, and related fees payable DIRECTLY to independent third-party providers

Direct Payments

MTP does not hold, control, or guarantee funds intended for third-party providers. All medical and related fees are paid directly by you to the relevant providers.

No Refund Liability

MTP is not responsible for refunds, chargebacks, cancellation fees, or disputes relating to third-party provider services. Any refund requests must be directed to the relevant provider.

Non-Refundable Coordination Fees

Unless otherwise expressly stated in your executed Quotation, all MTP Coordination Fees are non-refundable once coordination services have commenced, regardless of whether the medical procedure is ultimately performed.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Aggregate Liability Cap

MTP’S TOTAL AGGREGATE LIABILITY, IF ANY, SHALL NOT EXCEED THE FEES PAID BY YOU TO MTP FOR THE SERVICES GIVING RISE TO THE CLAIM.

Damages Exclusion

IN NO EVENT SHALL MTP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including but not limited to:

  • Loss of profits or revenue
  • Loss of use or data
  • Pain and suffering
  • Emotional distress
  • Loss of opportunity

Third-Party Acts

MTP is not liable for the acts, omissions, negligence, or misconduct of:

  • Healthcare Partners (hospitals, clinics, physicians)
  • Affiliated service providers
  • Transportation providers
  • Accommodation providers
  • Any other third parties

Exceptions

Nothing in these Terms limits liability for fraud, willful misconduct, or gross negligence to the extent such limitation is prohibited by applicable law.

7. Force Majeure

MTP bears no liability for any delay, disruption, cancellation, or failure to perform arising from events beyond its reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, hurricanes)
  • Pandemics, epidemics, or public health emergencies
  • War, terrorism, or civil unrest
  • Government actions, restrictions, or regulatory changes
  • Travel disruptions (flight cancellations, border closures)
  • Visa delays or denials
  • Transportation failures
  • Labor disputes or strikes
  • Cyber incidents or system failures
  • Third-party service failures
  • Any other circumstances beyond MTP’s reasonable control

8. Indemnification

You agree to indemnify and hold harmless MTP Consulting S.A. and its directors, officers, employees, contractors, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your medical treatment or care
  • Your conduct or actions
  • Your breach of these Terms
  • Your violation of any applicable law
  • Any dispute between you and a Healthcare Partner

Exception: This indemnification does not apply to the extent a claim is finally determined by a court or arbitral tribunal to result directly from MTP’s gross negligence or willful misconduct.

9. Health Data Processing

Transient Processing Model

Health-related data (medical records, imaging, diagnostic reports, treatment history) is processed on a TRANSIENT basis for transmission to Healthcare Partners. Such data is NOT retained in permanent files and is deleted from MTP’s systems without undue delay after confirmed transmission, except where retention is required to establish, exercise, or defend legal claims.

No Clinical Review

MTP does not analyze, interpret, or provide medical opinions regarding any medical data transmitted. Our review is limited to verifying that files are complete and readable for transmission.

Healthcare Partners as Independent Controllers

Once your health data is transmitted to a Healthcare Partner, that provider becomes an independent data controller responsible for their own data handling, security, and compliance.

10. Governing Law

These Terms and Conditions are governed exclusively by the laws of the Republic of Panama, without regard to conflict of law principles.

11. Dispute Resolution

Binding Arbitration

Any dispute, claim, or cause of action arising out of or relating to these Terms, our services, or your relationship with MTP shall be resolved exclusively by binding arbitration administered by the Centro de Conciliación y Arbitraje de Panamá (CeCAP) in Panama City, Panama, conducted in English.

Waiver of Rights

By agreeing to these Terms, you waive the right to:

  • Pursue claims in any court or tribunal
  • Participate in a class action or representative proceeding
  • Have a jury trial
  • Appeal the arbitral award (except as permitted by Panama law)

The arbitrator’s decision is final and binding and may be enforced in any court of competent jurisdiction.

Limitation Period

Any claim must be brought within twelve (12) months from the date you became aware of the circumstances giving rise to the claim.

12. Third-Party and Affiliate Services

Independent Service Providers

MTP may engage affiliated or third-party entities to provide local, non-medical support services, including:

  • Transportation and ground logistics
  • Accommodation coordination
  • In-country administrative assistance
  • Translation and interpretation services

Any such entities act exclusively as independent service providers and NOT as agents, partners, joint venturers, or representatives of MTP.

Any language assistance or communication support provided by MTP is strictly non-clinical and administrative. MTP does not interpret or explain medical information.

No Supervision or Control

MTP does not supervise, control, or direct such entities and assumes no responsibility or liability for their acts, omissions, negligence, or service quality.

Provider Variations

Pricing, scheduling, availability, treatment plans, provider assignments, and recovery timelines are determined solely by independent providers and may change at any time without notice from MTP.

13. Electronic Acceptance

Valid Agreement

Electronic acceptance of these Terms (whether by clicking “I Agree,” checking a box, using our services, or other electronic means) constitutes a valid and binding agreement equivalent to a handwritten signature.

Language

These Terms are provided in English. The English version prevails over any translation in case of conflict.

Notices

Notices from MTP to you may be delivered electronically and are deemed received within forty-eight (48) hours of transmission. Notices from you to MTP are effective only upon confirmed receipt by MTP.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. Changes will be posted with a new effective date.

Continued use of our services after the effective date of changes constitutes acceptance of the updated Terms.

15. General Provisions

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

No Waiver

No waiver of any provision of these Terms is effective unless in writing and signed by MTP. Failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign or transfer these Terms without MTP’s prior written consent. MTP may assign these Terms freely to an affiliate or successor entity.

Entire Agreement

These Terms, together with any signed agreements, constitute the entire understanding between you and MTP regarding the subject matter hereof.

No Fiduciary Relationship

MTP does not act as a fiduciary, advisor, insurer, guarantor, or representative. Our role is strictly limited to administrative coordination as described in these Terms.
